Youngstown Diocesan Confederation of Teachers
Current Contract - Article 2 - Recognition

Section 1: Recognition of Confederation

The Youngstown Diocesan Office of Catholic Schools, hereafter referred to as the "Office," and the Youngstown Diocesan St. Patrick Parish/School [Although using references to St. Patrick Parish in the text posted here, the terms of the contract apply to all
diocesan elementary schools having contracts with YDCT.], hereafter referred to as the "parish/school," recognizes the Youngstown Diocesan Confederation of Teachers, National Association of Catholic School Teachers, Local 3504, hereafter referred to as the "Confederation," as the sole collective bargaining representative for all certified, contracted teachers, full or part-time (except as provided by this contract) employed by the parish/school, subject to the following exceptions:
 
A. The Confederation shall not be the bargaining agent for the priests and for teachers in a religious order.

B. The Confederation shall not represent or be the bargaining agent for principals, assistant principals, head teachers and administrators.

Section 2: Parish Operation of the School

The Confederation recognizes that the parish operates the school and is the employer of teachers employed at said school.
 

Section 3: Recognition of Bishop and Board of Education

The parish and the Youngstown Diocesan Confederation of Teachers recognize that the school is one of a number of schools in the Youngstown Diocese, and that the Bishop has vested the Youngstown Diocesan Board of Education or Office of Catholic Schools with supervisory authority over the educational instruction provided in all diocesan schools. Nothing in this agreement is intended to limit or deprive the Youngstown Diocesan Board of Education of their authority, as conferred by the Bishop, and the agreement shall not be construed as interfering with the right and duty of the Youngstown Diocesan Board of Education to exercise such authority with respect to the adoption and enforcement of standards governing educational instruction, teacher qualifications and the operation of diocesan schools except as limited by the expressed terms of this contract.

Section 4: Rights of Confederation Officers

The Confederation president shall be granted up to four (4) Confederation business days, per year, to conduct legitimate union business provided the cost of the substitute is borne by the Confederation.  The vice-president shall be granted up to two (2) [during a negotiations year, three (3)] convederation business days, per year, to conduct legitimate unioin business provided the cost of the substitute is borne by the Confederation.  The Confederation secretary and treasurer will be granted two (2) Confederation business days, if possible, to conduct legitimate union business provided the cost of the substitute, selected by the building principal/director, is borne by the Confederation.  Said Confederation business days shall be granted according to the provisions of the Basic Contract and shall not be deducted from the teacher's accumulated sick leave days.  All Confederation officers will give twenty-four (24) hours notice, prior to the use of the day(s), whenever possible.  If tow (2) or more Confederation officers are from the same building, all efforts will be made to minimize the interruption of instruction.
