Current Contract - Article I - Management Rights |
Section 1: Reserved Rights, Powers, Authority, Duties and Responsibilities
St. Patrick
Parish [Although using references to St. Patrick Parish
in the text posted here, the terms of the contract apply to all
diocesan
elementary schools having contracts with YDCT.], acting independently
or in conjunction with the Youngstown Diocesan Board of Education, the
superintendent of the diocesan schools, the Office of Catholic Schools,
or their administrators at the school or diocesan level, retain and reserve,
without limitation, all powers, rights, authority, duties and responsibilities
conferred by the Bishop of Youngstown, including but not limited to:
A. the executive management and administrative control of St. Patrick Parish, its property and facilities;Section 2: Exercise of Rights, Powers, Authority, Duties and ResponsibilitiesB. the right to determine the mission and purpose of the school;
C. the right to establish a budget, make expenditures and determine the number of employees;
D. the right to direct, supervise, evaluate and hire employees, determine the qualifications of employees, and determine the duties, responsibilities and assignment of teachers;
E. the right to establish grades, courses of instruction, and determine curriculum, class size, hours of instruction and selection of textbookds;
F. the right to layoff, suspend, remove, nonrenew or discipline employees;
G. the right to make demands on teachers to insure quality and excellence in educational programs (lesson plans, course of study objectives, pupil performance objectives, etc.); and
H. the right to operate and maintain the parish school and to set practices controlling this operation and maintenance.
The exercise of the foregoing powers, rights, authority, duties and responsibilities, the adoption of policies, rules, regulations and practices in furtherance thereof, and the use of judgment and discretion in connection therewith shall be limited only by the specific and expressed terms of this agreement; and then only to the extent such specific and expressed terms are in conformance with the views of the Catholic community as expressed by the Bishop of Youngstown through the Diocesan Board of Education and the Office of Catholic Schools.
Section 3: Nonexercise of Rights
By not exercising
the rights hereby reserved or by exercising them in a particular way, such
action shall not be deemed to be a waiver of the rights.
