Current Contract - Article 8 - Constriction

A.  In the event the School decides that a decline in enrollment, financial exigency or other reason requires constriction of the teaching staff, the School shall give notice of this determination to the Association as soon as possible. Whenever possible, notice of constriction for the following School year shall be given to the Association by May 1, but the School reserves the right to take action at any time.

B.  Determination of the teacher staff members to be constricted shall be made by the School.  In making this determination, the School shall consider and apply equally each of the following factors in its sole discretion.

1.  Subject or grade level teaching experience.
2.  Seniority.
3.  Academic qualifications and certification.
4.  Contribution to the religious education mission of the School.
5.  Involvement in School activities and co-curricular activities.
6.  Teaching competency, based on evaluation reports.
C.  The School shall forward the name and qualifications of any teacher who is constricted to the Superintendent of Schools of the Archdiocese in an effort to obtain substitute employment for the teacher, unless the teacher specifically requests that this not be done.
