Current Contract - Article 2 - Teacher Rights

A.  All teachers in the bargaining unit have the right to join the Association or not to join the Association.

B.  The decision of an individual teacher to join the Association or not to join the Association shall be respected by the School, the Association and all members of the bargaining unit.

C.  Except for confidential references obtained prior to employment, each teacher shall have the right to examine the teacher's personnel file maintained by the School upon request. The School shall maintain the confidentiality of each teacher's personnel file. No anonymous materials shall be placed in a teacher's personnel file. All materials to be placed in a teacher's personnel file during employment shall be provided to the teacher before filing. The teacher shall have the obligation to sign the materials, signifying only that the teacher has read the materials and not that the teacher agrees with its content. The teacher shall have the right to include a written response to any such material in the personnel file, and this response shall also be included in the personnel file.

D.  Upon written request, each teacher shall have the right to receive a copy of material in the teacher's personnel file. The School may restrict the number of requests during each School year after a teacher has submitted three (3) such requests during a single School year.

E.  Each teacher shall have the right to be reimbursed for expenditures made by the teacher for classroom decorations up to $75.00 per School year. All decorations for which reimbursement is made shall be the property of the School.

F.  Each teacher shall receive a copy of this Agreement with all exhibits. The cost of copying the Agreement for the teachers shall be shared equally by the School and the Association.

G.  Seniority of each teacher is based on the length of continuous service in the School, and shall be calculated from the first paid day of employment.

H.  Upon request and authorization from a teacher, the School shall cause Association dues to be deducted from the salary of the teacher. The Association will advise the School of the amount of the dues in writing, and will give written notice of any change at least thirty (30) days prior to the effective date of the change. A teacher may initiate the authorization or withdraw the authorization at any time, and the School will implement such change as soon as possible. All dues deducted from teacher salaries will be paid to the Association monthly.

I.  Should a teacher's grade for a student be changed, the Principal shall make a reasonable effort to discuss the circumstances with the teacher before the change in grade is made.

J.  Rights of teachers regarding military service shall be determined in accordance with the law.
