Current Contract - Article 1 - Recognition and Scope of Agreement

A. The School hereby recognizes the Association as the sole and exclusive bargaining agent for all full-time teachers engaged in professional duties in the School. Administrators, priests, members of religious communities and all non-teaching employees are excluded from this bargaining unit.  Administrators include all persons having administrative duties at the School except for full-time teachers who have an administrative title but maintain a full teaching schedule.

B. The parties specifically agree to the following principles relating to the conduct of the religious education ministry of the School.

1 . The traditions, laws, doctrine, teaching and norms of the Roman Catholic Church shall be respected and affirmed. All religious education policies of the Archdiocese of Newark shall be fully enforced at the School at all times. The rights of the pastor of Our Lady of Peace Church under the Canon Law of the Church shall be respected. The religious mission and identity of the School shall be supported at all times.

2.  The School is an institution involved in the saving mission of the Church. It retains the sole right and duty to operate in accordance with this mission.

3. The special nature and mission of the School requires that Catholic teaching and moral standards be upheld at all levels of operation.

4. The lay Catholic educator is a person who exercises a specific mission within the Church by living, in faith, a vocation to teach within the community structure of the School, sharing in the sLctifying mission of the Church and recognizing its magisterium. This requires a personal life witness in which personal actions conform to professed faith and moral principles.

5. All management prerogatives, including the right to take all appropriate personnel actions, are reserved to the School unless specifically modified by this collective bargaining agreement.
