Boston Archdiocesan Teachers Association
Current Contract - General Article

Recognizing that the prime purpose of the Archdiocesan Central High Schools is to provide education of the highest possible quality within the framework of Catholic truths for its students, we, the undersigned parties to this contract, agree to the following principles.

1. The Association and its members recognize and shall respect the uniqueness of the Archdiocesan Central High Schools in that it is Roman Catholic, committed to provide education within the framework of Catholic truths.

2. The Association and its members shall comply, abide by and teach in accordance with and within the framework of Catholic truths.

3. The Association and its members shall respect the moral, spiritual, religious and intellectual values of the students and aid in their spiritual moral and religious formation through exemplary living.

4. The Association and its members recognize the right of the Corporation to establish those religious and educational policies for the schools which are consonant with the Catholic religion and with the philosophy delineated in the attached excerpts of the NCCB Pastoral Message of November, 1972, "To Teach as Jesus Did."

5. The Association and its members recognize the unique position of the Archbishop of Boston as the Chief Teacher of moral principles as they relate to the philosophy and goals of the Corporation.

6. The Association and its members recognize that each teacher is to use his/her skill and expertise in the most effective and proper manner to improve the quality of Catholic education offered by the Archdiocesan Central High Schools.

7. A teacher may be discharged for the sole reason that the provisions of the Preamble or this article have been violated only if the discharge action has been initiated by the principal and approved by the Superintendent of Schools. The Superintendent shall state his/her reasons for the discharge in writing. If a teacher is discharged for the sole reason that the provisions of the Preamble or this Article, then the teacher's remedy shall not be through the regular grievance procedure contained in Article III herein, but rather shall be through the following procedure:

A. Upon discharge, the teacher may request a hearing within ten (10) school days with the Superintendent. The Superintendent shall grant the hearing within ten (10) school days from the date of receipt of the request. The teacher shall have the right to have an attorney present and/or representatives of BATA. The Superintendent shall render a decision within five (5) school days after the hearing.

B. If the teacher is not satisfied with the decision of the Superintendent, he may appeal said decision to the Director of Education within ten (10) school days after receipt of the Superintendent's decision. A hearing will be held with the Director of Education within ten (10) school days after receipt of notice of the appeal. The Director of Education shall render his decision within five (5) school days after the hearing.

C. If the teacher is not satisfied with the decision of the Director, he may appeal said decision to the Board of Trustees of the Archdiocesan Central High Schools of the Central High Schools, Inc. within ten (10) school days after receipt of the Director's decision. The Archbishop of Boston or his designee, or the Vicar General or the ranking moral theologian of the Archdiocese of Boston will be present. The Board of Trustees shall meet with the teacher within ten (10) school days after receipt of the notice of appeal or at some other mutually acceptable time. The Board of Trustees decision shall be final and binding.

D. The terms and conditions as expressed in Article III, Section 3(1) and (2) shall also apply to the aforementioned procedure.

8. The Employer shall endeavor to establish sound, clearlydefined policies.

9. The Employer shall strive to develop good morale within the teaching staffs of the various high schools.
