Current Contract - Article XVII - Extended Leaves of Absence

1. A leave of absence without pay of up to two (2) years will be granted to any teacher who joins the Peace Corps or serves in an Archdiocesan recognized lay missionary program or serves as an exchange teacher, and is a full time participant in any such programs. Upon return from such leave, a teacher will be considered as if he/she were actively employed by the Corporation during the leave and will be placed on the salary schedule at the level he/she would have achieved if he/she had not been absent.

2. Military leave will be granted to any teacher who is inducted or enlists in any branch of the armed forces of the United States. Upon return from such leave, a teacher will be placed on the salary schedule at the level which he/she would have achieved had he remained actively employed in the system during the period of his/her absence up to a maximum of three (3) years.

3. A leave of absence without pay or increment of up to one (1) year will be granted for the purpose of caring for a sick member of the teacher's immediate family. Additional leave may be granted at the discretion of the Corporation.

4. The Corporation will grant a leave of absence without pay or increment to any teacher to campaign for, or serve in a public office. A teacher on leave to campaign for, or serve in a public office shall not be entitled to return until the beginning of the next school year.

5. After five (5) years of continuous employment in the System, a teacher may be granted a leave of absence, without pay, for up to one (1) year for health reasons. Requests for such leave will be supported by appropriate medical reasons.

6. Any teacher whose personal illness extends beyond the period compensated will be granted a leave of absence without pay for such time as is necessary for complete recovery from such illness. Such leave of absence shall not exceed two (2) years.

7. Other leaves of absence without pay may be granted by the Corporation.

8. All benefits to which a teacher was entitled at the time his/her leave of absence commenced, including unused accumulated sick leave, will be restored to him/her upon his/her return, and the teacher will be assigned to the same position which he/she held at the time said leave commenced, if available or, if not, to a substantially equivalent position.

9. Any teacher requiring an extended leave of absence shall give written notice to the Corporation. All requests for renewals or extensions of leaves shall be applied for and replied to in writing.

10. Maternity/ Paternity/Adoption Leaves

A. 1. A teacher who has not completed teaching one (1) full academic year shall only be entitled to a maternity/paternity/adoption leave not to exceed twelve (12) school weeks from the commencement of said leave.

2. A teacher who has completed teaching one (1) full academic year shall be entitled to only one of the following maternity/paternity/adoption leaves:

a. a leave not to exceed twelve (12) school weeks from the commencement of said leave.

b. a leave for the remainder of the current school year.

c. a leave for the remainder of the current school year and the next full school year.


B. 1. A teacher must notify the principal and superintendent of his/her intent to take said maternity/paternity/adoption leave at least four (4) months prior to taking said leave.

2. A teacher must elect which one of said three (3) types of leave he/she intends to take at least one (1) week prior to expected date of delivery.

3. The teacher may work so long as she is medically fit, supported by a doctor's certificate, up to one (1) week prior to expected day of delivery.

4. Modifications to time period for said leaves may be made at the mutual agreement of both the teacher and principal.

5. A teacher who selects option b or c must notify the principal and superintendent on or before June 1 of his/her intention to return that September.


C. Failure to comply with the above conditions shall constitute a termination of said maternity/paternity/adoption leave.

D. A maternity leave of absence shall be without pay and increment. A teacher returning from maternity leave will be placed on the salary step held prior to taking said leave. However, if the teacher had taught in excess of ninety (90) school days before taking said leave, she will be entitled to move to the next step upon her return in September.

E. The sick leave provisions of this contract (Article XV) shall apply to disabilities resulting from pregnancy and childbirth. Medical certificates of disability may be required by the Corporation. The application of the sick leave provision shall not apply to other sickness or disabilities while a teacher is out on maternity/paternity/adoption leave.
