Current Contract - Article XII - Teacher Evaluation

1. All monitoring or observation of the work performance of a teacher will be conducted openly and with full knowledge of the teacher. The use of eavesdropping, public address or audio systems, and similar surveillance devices shall be strictly prohibited. All evaluations for a teacher's official professional record will be made only by an inter-school supervisor, principal, vice principal, department head and any representative of the Archdiocesan school office, all of whom will follow the procedures as outlined in this contract. Teachers will be given a copy of any evaluation report by their supervisor and will have the right to discuss such report with their supervisor.

2. Teachers will have the right, upon request, to review the contents of their personnel file. A teacher will be entitled to have a representative of the Association accompany him/her during such review. Upon receipt of a written request, the teacher in any school year shall be furnished two (2) reproductions of any or all materials in his/her file.

3. No material detrimental to the teacher's record or derogatory to a teacher's conduct, service, character or personality will be placed in his/her personnel file unless the teacher has had an opportunity to review the material and has been provided a dated copy of the material. The teacher will acknowledge that he/she has had the opportunity to review such material by affixing his/her signature to the copy to be filed with the express understanding that the signature in no way indicated agreement with the contents thereof. The teacher will also have the right to submit a written answer to such material and his/her answer shall be reviewed by the principal and attached to the file copy. No unsubstantiated materials shall be placed in a teacher's personnel file until investigated and the matter is found to be substantiated.

4. Any written complaints regarding a teacher made to any member of the administration by any parent, student or other person will be promptly called to the attention of the teacher.

5. The Association recognizes the authority and responsibility of the principal for disciplining or reprimanding a teacher for delinquency of professional performance. If a meeting is to be held by a principal or his/her designee at which a teacher is to be suspended or dismissed, that teacher shall have the right to have a BATA representative at such meeting.

6. No teacher will be reprimanded, disciplined, suspended, discharged, reduced in rank or compensation, or deprived of any professional advantage without just cause.

7. Evaluation procedures will recognize the distinction between professional competence and degree of adherence to Catholic principles. There shall be nothing derogatory regarding a teacher's professional competence entered on his/her record due to a poor evaluation of his/her adherence to Catholic principles. Anything derogatory about a teacher's adherence to Catholic principles shall be kept in a record separate and apart from the regular personnel record and shall never be made available to another employer.
