Current Contract - Article XI - Vacancies and Promotions

1. Whenever any vacancy in a teaching and/or guidance counseling position occurs during the school year, September to June, in any of the Central High Schools, and is to be filled by a lay person, it will be adequately publicized by means of a notice sent by the principals to the President of BATA as far in advance of the appointment as possible. Whenever the vacancy occurs in July or August, written notice of such vacancy will also be sent to the President of the BATA. Such notification to the lay teacher will be carried out in the individual schools by the BATA representative in each school. Should a position entail administrative duties and is considered by the Corporatior to be a non-bargaining unit position, that position will .till be duly advertised and said notice shall include the phrase: "This position is not within the teachers' bargaining unit."

2. In the above situations, the qualifications for the position, its duties, and the rate of compensation will be clearly set forth. The qualifications set forth for a particular position will not be changed when such future vacancies occur unless the Association has been notified in advance of such changes and the reasons therefor.

3. All qualified teachers will be given adequate opportunity to make application for such positions, and the Corporation agrees to give due weight to the professional background and attainments of all applicants, the length of time each has been in the school system and other relevant factors. In filling such vacancies, preference will be given to qualified teachers already employed by the Corporation, and each teacher applicant not selected will, upon request, receive a written explanation from the Superintendent or his/her designee.

4. Appointments will be made without regard to race, creed, color, nationality, sex, age, marital status or association activity.

5. (a) Within the first two (2) weeks of the school year the

Corporation will notify all principals of the current BATA

mailing address for such notifications.

(b) Within the first two (2) weeks of the school year the

Corporation will notify the President of the BATA of the

current principals within the system.

6. Lay administrative positions are not part of the bargaining unit. However, whenever a vacancy in an administrative position occurs which is to be filled by a lay person, in any of the Central High Schools, notice will be given in accordance with section 1 above. All qualified teachers will be given adequate opportunity to make application for such positions. In filling such vacancies, due consideration will be given to qualified teachers already employed by the Corporation. The decision of the Corporation is not subject to the grievance and arbitration procedure.
