Current Contract - Article IX - Teacher Employment

1. Full credit, not to exceed Step 5, will be given for previous relevant satisfactory outside teaching experience upon initial employment. Teachers initially hired into the system without any prior experience in the system who have been away from the field of education for three (3) years may be placed on an initial salary step at the discretion of the Superintendent or his/her designee with the Superintendent's knowledge and approval.

2. Teachers with previous teaching experience in the System will upon returning to the System receive credit on the salary schedule for all relevant outside and in-system teaching experience up to Step 8.

3. When practical, in order to fill any academic vacancies in the future, the Corporation agrees to hire only those teachers who are certified by the State Department of Education.

4. Teachers will be hired without regard to race, age, marital status, creed, color, nationality or sex.

5. Teachers must execute an individual teaching contract of employment with the Archdiocese each year setting forth only the assignment and salary of the teacher. Such contracts shall be the same for each school. The contracts shall incorporate by reference the Collective Bargaining Agreement. If an inconsistency exists between the individual contract and the Collective Bargaining Agreement, the Collective Bargaining Agreement shall control. After an individual contract is executed, a copy of said contract will be sent to the President of BATA.

6. The language contained in Article XII, section 6 does not apply to the non-renewal of a contract of employment for a teacher who has not taught in the system for more than three consecutive school years. Thus, decisions of nonrenewal for the second and/or third and/or fourth consecutive years are not subject to the grievance and arbitration procedure. Dismissal of a teacher during the course of a school year is subject to the just cause protection. Except for those teachers serving their first year in 1980-81, all teachers will be grandfathered relative to this new section. Written notice of nonrenewal will be given by the principal to a teacher on or before May 15th.

7. A teacher who leaves his/her employment during the course of the school year without the consent of the principal will be considered to have breached his/her contract of employment and will be subject to appropriate remedies.

8. The school year will be defined as 188 days including 180 student days and/or 990 hours of student instruction time. Up to eight (8) days may be used for professional development and/or teacher meetings and pre and post school year preparation.
