Current Contract - Article IIA - Management Rights

It is acknowledged that the Corporation has the final responsibility of establishing the policies of the school system. It is herein agreed that except as specifically and directly modified by express language in a specific provision of this Agreement, the Corporation and its agents retain all rights and powers that they have or may hereafter be granted by law in managing the School System and directing the work force.

Said rights and powers include but are in no way to be construed as limited to: the establishment of reasonable rules and regulations; the right to hire, suspend, discipline; to classify, promote, assign; to determine the hours for and the number of employees required at any location; to determine the qualifications of; to evaluate the performance of; any employee covered by this Agreement, and to introduce new or to change existing operational methods.

As to every matter not expressly covered by this Agreement and except as they are specifically or directly modified by the express language in a specific provision of this Agreement, the Corporation retains exclusively to itself all rights and powers that it has or may hereafter be granted by law, and may exercise the same at its discretion without such exercise being made the subject of a grievance, arbitration proceeding, or unfair practice charge, if these rights and powers are exercised in a manner compatible with the spirit and intent of this Agreement.
